February 17, 2009: Special Meeting of the Town Board

A Special Town of Floyd Board Meeting was held on Tuesday, February 17, 2009 at 6:30 PM. Town Supervisor John F. Buczek called the meeting to order.

Town Officials present were Supervisor John F. Buczek, Councilmen William E. Smith, Charles Planow and Clifford Kotary, Town Clerk Georgianna Larry, Highway Superintendent Jerome E. Alexander Jr., Town Attorney David Rapke, Constable Lloyd Miller, and Water Superintendent William H. Nemyier III.  Absent was Councilman Willard H. Streiff Jr.

Town Residents present were Donald Kotary, Jim and Marian Clarke.

Supervisor John F. Buczek told us the purpose of this Special Board Meeting is to open sealed bid packages for the contract of Sensus Water Meter Reading Transmitters.

6:30 PM Town Clerk read the legal notice for the Town of Floyd Specifications for Water Meter Reading Radio Transmitters.  She told us we only received one bid. 

The only bid was opened by Supervisor John F. Buczek and then passed over to Town Attorney David Rapke to examine.  He told us the following was included in the bid package:

Bidder's Name and Address was Team E. J. Prescott, Syracuse, NY Divison, Bid Form that consisted of the following:

Bid Item No. 1 - 607 MIU 510R NP Single Port TC W/ITR w/Leak Detection for $105.00/unit for a total cost of $63,735.00.

Bid Item No. 2 - 178 MIU 520R Pit Single Port TC w/Leak Detection for $112.50/unit for a total cost of $20,025.00.

Bid Item No. 3 - 1 Meter Seal Press for a total cost of $123.78.

Bid Item No. 4 - 113 Linear Feet Galv. Meter Seal Wire, Calculated w/2" Wire Per MXU for $.14/ft. for a total cost of $15.82.

Bid Item No. 5 - 672 Roto-Seal Lead Free Meter Seals for $.40/unit for a total cost of $268.80.

Bid Item No. 6 - 534 Two Wire Gel Cap E-9Y for $.17/Unit for a total Cost of $90.78.

Bid Item No. 7 - 1 Five Ft. SB Pipe Auger Cleaner CA-5 for a total cost of $53.55. 

The total cost of everything above is $84,312.73.  Mr. Rapke said that Collusive Bidding Certificate was signed, Bid Bond for 10% of the total bid were also included in the Bid Package.  He told us the Bid Package is complete, conforms to the specs, and should refer it to our Town Engineer C. Jack Dodson for his approval.

Discussion followed with Water Superintendent William H. Nemyier III on the installation of these Water Meter Reading Radio Transmitters.  This complete Bid Package will be fax to Town Engineer C. Jack Dodson early tomorrow morning.

Councilman William E. Smith made a motion to authorize the contract of Sensus Water Meter Reading Transmitters to Team E. J. Prescott for the purchase of the items in the specifications for a total amount of $84,312.73 contingent upon the approval of our Town Engineer C. Jack Dodson P.E., seconded by Councilman Clifford Kotary.  Next Supervisor John F. Buczek asked Town Clerk Georgianna Larry to call for a roll call vote that resulted in the following:

          Ayes:  William E. Smith, John F. Buczek

                      Charles Planow, Clifford Kotary

          Nays:  None

          Absent:  Willard H. Streiff Jr.

          The above motion is adopted.

Councilman Willard H. Streiff Jr. arrived at 6:50 PM.

On February 11th we have had two presentations from Bill Cole of Gates, Cole Associates, Inc. for Insurance Coverage for Liability, Fire, Comprehensive for Equipment, Buildings, etc. for the Town of Floyd.  With some modifications to the Houston Casualty Insurance Company, we asked Bill Cole if he could extend this contract for three years, and he said yes.  Discussion followed.

Supervisor John F. Buczek made a motion to award the contract with Houston Casualty Insurance Company and Utica National Insurance for Insurance Coverage to Gates Cole Associates, Inc. for General Liability, Fire, Comprehensive for Equipment, Buildings and Property, etc. for the Town of Floyd for a total amount of $29,491.60 regarding a three year locked - in rate effective March 9, 2009 through Mach 8, 2012 and they advised that our premium would not increase more than 2-5% over three years should our loss experience remain good and the town's exposures not change and furthermore the charge will be borne by each respective fund and the proportionate share of premiums will be on the General, Refuse and Garbage, and the Water Improvement Warrants.  Seconded by Councilman Clifford Kotary.  Next, Supervisor John F. Buczek asked Town Clerk Georgianna Larry to call for a roll call vote that resulted in the following:

          Ayes:  William E. Smith, Willard H. Streiff Jr.

                      John F. Buczek, Charles Planow, Clifford Kotary

Nays:  None

          The above motion is adopted.

Discussion followed on Double Wide Mobile Homes being allowed in

R-A Zoning Districts in town. 

7:10 PM Councilman Charles Planow made a motion to adjourn, seconded by Councilman Willard H. Streiff Jr., and carried.
